NOOH & Nest · Customer Information

Terms & Conditions

These terms explain how our studio and rehearsal-space bookings work, what you can expect from us, and what we ask of customers using our facilities. Please read them before making a reservation. By placing a booking, you agree to the terms that apply to that reservation, subject to your statutory rights.

1. About these terms

These Terms & Conditions apply to bookings and use of the studio and rehearsal spaces offered by NOOH & Nest, operated by NOOH LTD, a company registered in England and Wales under company number 16538874.

In these terms, “we”, “us” and “our” refer to NOOH LTD trading as NOOH & Nest. “You” and “your” refer to the person making a booking and, where applicable, the people attending under that booking. “Studio” means the space reserved for your session, including any facilities or equipment expressly included in the confirmed booking.

These terms should be read with your booking confirmation, any written arrangements agreed for your session, and our Cancellation & Refund Policy. If a specific written booking agreement expressly varies one of these terms, that agreement will apply to the extent of the agreed variation. Mandatory legal rights always take priority over inconsistent contractual wording.

Please check before booking: Confirm the date, start time, duration, intended activity, price and any specific requirements before completing your reservation. If something is unclear, contact us before paying.

2. Our services

NOOH & Nest provides studio and rehearsal-space hire by reservation. Depending on the particular space and booking, facilities may include mirrors, suitable flooring and sound equipment for individual practice or group rehearsal.

The facilities available for a specific session will depend on the space selected and the details confirmed at the time of booking. Not every facility is necessarily available in every room or included in every price. Please ask us to confirm any essential requirement before making a payment.

Our service is the provision of the agreed space for the confirmed time and purpose. Unless expressly included in writing, the booking does not include an instructor, choreographer, performer, event organiser, technical operator, personal assistant or other separately supplied service.

You are responsible for deciding whether the space is suitable for your intended activity. If your activity requires unusual equipment, additional space, special access arrangements or other facilities, you must discuss those requirements with us before the booking is confirmed.

3. Customer eligibility and authority

You must provide accurate information when making a booking and have the authority to accept these terms. If you make a reservation on behalf of a group, organisation or other person, you are responsible for ensuring that the booking details are correct and that the group understands the relevant studio rules.

You must not make a booking using another person’s payment details or personal information without proper authorisation. We may ask for proportionate information to verify a reservation or resolve a genuine booking or payment query.

If a booking involves children or young people, the person arranging the session must contact us in advance where supervision, consent or additional arrangements may be needed. Any applicable legal safeguarding obligations must be observed. We may decline or require changes to a proposed arrangement where reasonably necessary for safety or compliance.

4. Booking requirements

4.1 Advance reservations

All studio sessions must be arranged in advance. Bookings must be requested at least 24 hours before the intended start time. We do not accept same-day bookings through the standard booking process.

A request submitted within the 24-hour period does not create a confirmed reservation, even if the website appears to accept an enquiry. You should wait for our written confirmation before travelling to the studio or arranging other services around the session.

4.2 Accurate booking information

You must provide the intended date and time, expected duration, approximate number of attendees and a clear description of the proposed activity. Any special access, equipment or space requirements should be disclosed before confirmation.

We may ask follow-up questions where information is missing, inconsistent or needed to assess availability and suitability. We may decline a request if we cannot reasonably confirm the space, timing or requirements.

4.3 Intended use and group size

A reservation is for the activity and number of attendees agreed with us. You must not materially change the purpose of the session, exceed any stated occupancy limit or introduce additional activities without our prior agreement.

If the size or nature of your group changes, contact us before the session. We will advise whether the existing arrangement remains suitable or whether a different booking is required.

4.4 No unauthorised onward booking

You must not resell, sublet, transfer or otherwise make the reserved space available to another person or organisation without our written agreement. A booking may not be used for an activity materially different from the one described in the confirmed reservation.

5. Confirmation and availability

Submitting a contact form or booking enquiry is a request, not a guarantee that a particular room or time is available. A reservation becomes confirmed when we have reviewed the request, agreed the essential details and sent written confirmation through an official communication channel.

Where payment is required before confirmation, we will explain the payment arrangement. Unless we expressly state otherwise, sending payment alone does not confirm a booking if the date, time or service details remain unresolved.

Please review your confirmation promptly. If the name, date, start time, duration, intended use or price is incorrect, contact us as soon as possible. We will review the issue and confirm any agreed correction in writing.

We take reasonable care to maintain accurate availability information. However, a technical error, conflicting reservation or other genuine operational issue may occasionally prevent us from accepting a requested slot. If we cannot provide a reservation that we have already confirmed, Section 13 and Section 15 explain the steps we may take and the options available to you.

6. Prices, payment and receipts

6.1 Prices

The price applicable to your booking will be stated in the relevant service listing, quotation or written confirmation. Prices may vary according to the space, duration, facilities, date and requirements of the session.

Unless expressly stated otherwise, the confirmed price covers only the agreed booking and included facilities. Additional time, equipment, services or other arrangements may involve an additional charge, but we will explain and obtain agreement to any such charge before it is applied.

6.2 Payment arrangements

After reviewing your requirements and confirming the relevant booking details, we will provide the payment information and arrangements through an official communication channel. The payment method available may depend on the agreed service arrangement.

You must follow the payment instructions provided for your reservation and ensure that any required payment is made by the stated deadline. If a payment deadline has not been specified, contact us to clarify the arrangement before assuming the booking is secured.

Do not send payment to an account or recipient that cannot reasonably be verified as authorised by us. If you receive unexpected payment instructions or notice a discrepancy, contact us through the details published on our website before proceeding.

6.3 Payment confirmation and records

We may issue a booking confirmation, receipt or other payment record appropriate to the transaction. You should retain your confirmation and proof of payment until the booking and any related refund matter have been completed.

If a payment is delayed, reversed, duplicated or recorded incorrectly, contact us with the booking reference and relevant transaction details. We will check the available records and work with you to resolve a verified discrepancy.

6.4 Taxes and additional charges

Any applicable taxes and mandatory charges will be handled in accordance with the price information and relevant legal requirements. We will explain any additional charge before asking you to agree to it. We will not introduce an undisclosed mandatory fee after the booking has been confirmed.

7. Cancellation and refunds

Customer cancellations and refund calculations are governed by our Cancellation & Refund Policy, which should be read alongside these terms. The standard refund schedule for customer-requested cancellations is summarised below.

When the cancellation is received Standard refund
At least 120 hours before the booking starts 100%
At least 72 but less than 120 hours before the start 80%
At least 24 but less than 72 hours before the start 40%
Less than 24 hours before the start 0% under the standard schedule

The relevant period is measured from the confirmed start time using complete 24-hour periods. A cancellation request must be received through an official contact channel and must identify the booking clearly.

No-shows, late arrivals, early departures and requests made after a session has started are not normally refundable under the standard schedule. Exceptions may be considered where appropriate, and statutory rights remain unaffected.

If we cancel a confirmed booking and cannot provide a suitable alternative that you accept, we will refund the amount paid for the affected service in full where the service has not been supplied, subject to applicable law.

Approved refunds will normally be initiated within 5 working days after the amount has been confirmed. Funds usually appear within 5–10 working days after initiation, depending on the bank and payment provider. Any shorter deadline required by law will take priority.

Please refer to the full Cancellation & Refund Policy for details on eligible cancellations, exceptional circumstances, partial bookings, rescheduling and refund queries. If you need a copy or cannot locate the policy, contact us through our Contact page.

8. Changes, rescheduling and extensions

8.1 Changes requested by you

Requests to change the date, time, duration, space or agreed activity must be submitted through an official contact channel. Changes depend on availability and are not effective until we confirm them in writing.

If the change affects the price, facilities or other material terms, we will explain the revised arrangement before it takes effect. If the proposed change cannot be accommodated, the original booking remains subject to its existing terms and the Cancellation & Refund Policy.

8.2 Additional time

You must not continue using the studio beyond the confirmed end time without permission. An extension may be possible if the space is available and we have agreed the additional charge or other arrangements in advance.

If another reservation follows yours, you must leave the space on time so the next customer can use it as scheduled. We cannot guarantee that extra time will be available on the day.

8.3 Changes made by us

If an operational issue requires us to change a material aspect of your confirmed booking, we will notify you as soon as reasonably practicable. Where possible, we may offer an alternative space or time. If the alternative is not suitable and the booked service cannot be provided, the refund arrangements in Section 7 and Section 13 will apply.

9. Arrival, access and use of booked time

Please arrive at the agreed time and follow the access instructions provided with your booking confirmation. If entry arrangements require a meeting, code or other instruction, keep those details secure and use them only for the confirmed reservation.

Your booking covers the stated session period. Unless we expressly agree otherwise, preparation, set-up, packing away and leaving the room must take place within that period. Please allow enough time to finish your activity and leave the space by the scheduled end time.

If you are delayed or cannot access the studio, contact us promptly. We will review the circumstances and advise whether assistance is available. A delay caused by the customer does not automatically extend the reservation or entitle the customer to a refund.

You must not enter restricted areas, interfere with building access arrangements or remain on the premises outside your authorised booking period. If you find that the space is not ready or that access differs materially from the confirmed arrangement, contact us before using the facilities so we can assess the issue.

10. Studio use and customer conduct

10.1 Permitted activities

You may use the reserved space for the activity agreed during booking. You must not use it for unlawful purposes, activities that create an unreasonable safety risk, or activities that materially differ from the confirmed purpose without our prior agreement.

10.2 Respect for others

You and your attendees must behave respectfully towards staff, other customers, neighbours and anyone else lawfully using the premises. Harassment, threatening conduct, deliberate disruption and abusive behaviour are not acceptable.

10.3 Noise and sound equipment

Sound equipment must be used responsibly and at a level appropriate to the space and any instructions provided. You must follow any reasonable noise restrictions, building requirements or directions communicated for the session.

10.4 Cleanliness and waste

Please leave the space in a reasonably clean and orderly condition. Remove personal items and dispose of waste using the arrangements provided. Do not leave food, drinks, packaging or other materials that could affect the next user or the condition of the premises.

10.5 Prohibited conduct

Without prior written agreement, you must not:

  • Exceed the agreed occupancy or any applicable safety limit.
  • Smoke or use prohibited substances inside the premises.
  • Bring hazardous materials, open flames or equipment that creates an unreasonable risk.
  • Alter, remove or interfere with fixtures, fittings, mirrors or installed equipment.
  • Block entrances, exits, corridors or access routes.
  • Make structural changes, attach items to walls or floors, or use materials that may cause damage.
  • Record, photograph or film another person in circumstances where doing so would breach their rights or reasonable privacy expectations.
  • Use the premises for unlawful, deceptive or unauthorised commercial activity.

If you are unsure whether a proposed activity is permitted, ask us before the booking. We may set reasonable conditions or decline an activity where necessary to protect people, property or the suitability of the space.

11. Equipment, facilities and damage

11.1 Included equipment

Only equipment and facilities identified in the booking confirmation or otherwise agreed in writing are included in the reservation. Availability may differ between spaces. Please do not assume that additional equipment is included unless this has been confirmed.

11.2 Reasonable care

You must use the space, mirrors, flooring, sound equipment and other facilities carefully and in accordance with any instructions provided. Report a fault or damage as soon as you notice it. Do not attempt repairs or adjustments that could create a safety risk or cause further damage.

11.3 Damage caused during a booking

You may be responsible for reasonable, evidenced repair or replacement costs where damage is caused by your negligence, deliberate conduct or breach of these terms, subject to applicable law. We will consider the condition of the item, the circumstances, reasonable repair options and supporting evidence when assessing a claim.

Ordinary wear and tear, pre-existing damage and faults not caused by you will not automatically be charged to you. We will explain the basis of any proposed charge and provide reasonable supporting information on request.

11.4 Reporting a problem

If equipment is missing, damaged or not functioning as expected, notify us promptly. Do not continue using equipment if doing so could create a risk. We will assess the reported issue and, where appropriate, discuss an alternative arrangement or other remedy.

12. Safety and personal belongings

12.1 Safe use of the space

You are responsible for ensuring that your planned activity is suitable for the space and that participants use it responsibly. Warm-ups, movement, group spacing and equipment use should be managed with reasonable care according to the nature of the activity.

You must follow safety instructions, keep access routes clear and stop using any facility that appears unsafe. Report hazards, accidents or damage to us as soon as reasonably possible.

12.2 Personal belongings

Please keep personal belongings secure and take all items with you when leaving. Unless we expressly agree to store an item, we do not provide a separate personal storage service. Items left behind may be retained temporarily while we try to arrange collection, but we cannot guarantee that lost property will be recovered.

12.3 Medical and individual requirements

You are responsible for considering whether you and your attendees are able to participate safely in the intended activity. If you require an access arrangement or other practical adjustment, please contact us before booking so we can discuss what is reasonably available.

We do not provide medical advice, personal training or professional supervision unless expressly agreed as a separate service. You should seek suitable professional advice where necessary for your own circumstances.

13. Suspension, refusal of access and termination

We may refuse access, pause a session or end a booking where reasonably necessary because of a serious or continuing breach of these terms, a material safety concern, unlawful activity, serious disruption, unauthorised use or a credible risk to people or property.

Where the situation allows, we will explain the concern and give you an opportunity to resolve it. Immediate action may be necessary where delay would create a safety risk, allow unlawful conduct to continue or cause material damage.

If a booking is ended because of the customer’s conduct or a material breach, unused time will not automatically be refunded. Any amount retained or refunded will depend on the circumstances, the service supplied, the terms agreed and applicable law. We will not rely on this section to remove a legal right to a refund or other remedy.

If we end or cancel a booking because we cannot provide the agreed service for reasons attributable to us, we will explain the available options. Where the service has not been supplied and a refund is due, we will return the relevant amount in accordance with Section 7 and applicable law.

14. Liability and limitations

14.1 Our responsibilities

We will provide the booked service with reasonable care and skill and take reasonable steps to ensure that the confirmed space and included facilities are available for the agreed period. If something goes wrong, please tell us promptly so that we have an opportunity to investigate and respond.

14.2 Matters outside our reasonable control

The availability or operation of a studio may be affected by events such as utility interruptions, unexpected building issues, equipment faults, severe weather or restrictions imposed by a relevant authority. We will take reasonable steps to communicate material disruption and consider practical alternatives.

14.3 Customer and third-party conduct

To the extent permitted by law, we are not responsible for loss or damage caused by a customer’s own negligence, deliberate misconduct, failure to follow reasonable instructions or use of the premises outside the agreed purpose. We are also not automatically responsible for the independent acts or omissions of third-party suppliers with whom you have made separate arrangements.

14.4 Indirect costs and losses

Unless expressly agreed in writing or required by law, we do not undertake to reimburse separate expenses such as travel, accommodation, performer fees, instructor fees, equipment hired independently or lost income arising from a booking change or cancellation. Any claim for additional loss will be assessed according to the circumstances and applicable law.

14.5 Non-excludable liability

Nothing in these terms excludes or restricts liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or restricted.

Nothing in these terms limits your rights under the Consumer Rights Act 2015 or other applicable consumer protection legislation. Where a service is not supplied with reasonable care and skill, or where another statutory remedy applies, those rights remain available.

14.6 No blanket disclaimer

Information about the studio and its facilities is provided to help you decide whether a booking is suitable. It does not replace confirmation of specific requirements. We will not use a general disclaimer to avoid a responsibility that the law places on us or to remove a right that cannot lawfully be excluded.

15. Events beyond our reasonable control

An event beyond reasonable control may include severe weather, flooding, fire, a major utility failure, public emergency measures, transport disruption, an unexpected building closure or another event that could not reasonably have been prevented or overcome.

If such an event affects your booking, we will consider whether the studio can safely remain available, whether another suitable arrangement is possible and whether the session needs to be rescheduled or cancelled.

If we cannot supply a paid service and a refund is required under the booking terms or applicable law, we will provide that refund. An event beyond reasonable control does not automatically remove a customer’s statutory rights. Equally, an event affecting a customer’s ability to attend does not automatically entitle the customer to a full refund outside the applicable cancellation terms.

We will communicate material changes as soon as reasonably practicable using the contact details available for the booking. You should ensure that those details remain accurate.

16. Privacy and communications

We use the information you provide to handle enquiries, assess availability, administer bookings, communicate relevant changes, process payments and refunds, respond to complaints and maintain appropriate business records.

We take reasonable steps to handle personal information securely and only retain it for as long as reasonably necessary for the relevant purpose, subject to legal, accounting and record-keeping requirements. Where appropriate, information may be shared with service providers who assist with our booking administration, communications or payment arrangements.

We do not ask you to send unnecessary sensitive information through ordinary booking messages. Please do not include full payment-card details, security codes, account passwords or other credentials in an email or contact form.

We may contact you about a reservation, a payment, a change, a cancellation or a service issue using the details you supplied. Please tell us if your contact information changes or if you believe a message relating to your booking has been sent in error.

Further information about the handling of personal information should be read in our Privacy Policy. You can contact us if you need assistance locating that policy or have a question about information associated with your reservation.

17. Complaints and disputes

If you have a concern about a booking, the condition of a space, the facilities supplied, a payment or a refund, please contact us with your booking reference and a clear description of the issue. Where relevant, include the date and time of the session and any correspondence that may help us understand what happened.

We aim to acknowledge complaints within 5 working days and provide a substantive response within 15 working days. If additional information or investigation is needed, we will explain the reason for the delay and provide an updated response timeframe.

We will review complaints fairly and consider the booking confirmation, information supplied by the parties, the service provided and applicable legal obligations. Where we identify an error, we will explain the steps proposed to address it.

If a dispute cannot be resolved directly, you may seek independent advice or use any consumer dispute-resolution route available to you. Nothing in these terms prevents you from bringing a claim before a court with appropriate jurisdiction.

18. General provisions

18.1 Changes to these terms

We may update these terms from time to time to reflect changes to our services, booking arrangements or legal requirements. The version applicable to an existing booking will normally be the version in force when the booking was confirmed, unless a change is required by law or we agree a variation with you. We will not use an update to remove an accrued legal right.

18.2 Accuracy of information

We take reasonable care to keep service descriptions, prices and booking information accurate. If we discover a material error affecting a proposed or confirmed reservation, we will contact the customer and explain the available options rather than silently applying a materially different arrangement.

18.3 Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent that they can operate lawfully. The affected provision will be interpreted or limited only as far as necessary to comply with the law.

18.4 No automatic waiver

If we do not enforce a term immediately, this does not mean that we have permanently waived it. Any agreed exception applies to the specific circumstances confirmed and does not automatically change the terms of other bookings.

18.5 Third-party rights

Unless expressly stated otherwise, these terms do not give a person who is not a party to the booking a right to enforce them under the Contracts (Rights of Third Parties) Act 1999. This does not affect any independent rights that person may have under applicable law.

18.6 Governing law and jurisdiction

These terms are governed by the laws of England and Wales, subject to any mandatory consumer protection rules that apply to your circumstances. Where a dispute proceeds to court, the applicable rules on jurisdiction will apply. Nothing in this section removes any right a consumer may have to bring proceedings in another court where the law permits.
